1   Short title

This declaration may be cited as the Fisheries (Spanish Mackerel) Amendment Declaration 2022.

2   Commencement

This declaration commences on 22 October 2022.

3   Declaration amended

This declaration amends the Fisheries Declaration 2019.

4   Insertion of new ss 38A and 38B

After section 38—
insert—

38A   Taking or possessing spanish mackerel in regulated periods—northern spanish mackerel waters

(1)A person must not in the northern spanish mackerel waters—
(a)take a spanish mackerel in a regulated period; or
(b)possess a spanish mackerel taken in contravention of paragraph (a).
(2)However, subsection (1) does not apply to a recreational fisher taking part in a licensed charter fishing trip.
(3)For subsection (1)(a), each of the following periods is a regulated period—
(a)from 22 October 2022 to 12 November 2022;
(b)from 21 November 2022 to 12 December 2022.

38B   Taking or possessing spanish mackerel in regulated periods—southern spanish mackerel waters

(1)A person must not in the southern spanish mackerel waters—
(a)take a spanish mackerel in a regulated period; or
(b)possess a spanish mackerel taken in contravention of paragraph (a).
(2)However, subsection (1) does not apply to a recreational fisher taking part in a licensed charter fishing trip.
(3)For subsection (1)(a), each of the following periods is a regulated period—
(a)from 1 February 2023 to 21 February 2023;
(b)from 1 March 2023 to 21 March 2023.

5   Amendment of sch 1 (Regulated waters)

(1)Schedule 1, part 1, after entry for northern rocklobster waters—
insert—

northern spanish mackerel waters

tidal waters east of longitude 142º31'49'' east and north of latitude 22º south

section 38A

(2)Schedule 1, part 1, after entry for sea cucumber waters—
insert—

southern spanish mackerel waters

tidal waters east of longitude 142º31'49'' east and south of latitude 22º south
