Fisheries (Saucer Scallops) Amendment Declaration 2021 (Qld)

1   Short title

This declaration may be cited as the Fisheries (Saucer Scallops) Amendment Declaration 2021.

2   Commencement

This declaration commences on 1 September 2021 immediately after the commencement of the Fisheries Legislation Amendment Regulation 2020, chapter 4, part 2.

3   Declaration amended

This declaration amends the Fisheries Declaration 2019.

4   Insertion of new ch 2, pt 12, divs 1 and 1A

Chapter 2, part 12—
insert—

Division 1 Southern offshore trawl region A and southern offshore trawl region B

86   Using trawl nets in southern offshore trawl region A or southern offshore trawl region B

(1)A person must not use a trawl net in the southern offshore trawl region A or the southern offshore trawl region B in a regulated period.

(2)However, subsection (1) does not apply to—

(a)a person using a trawl net in waters south of the eastern tip of Point Cartwright; or

(b)a person using an otter trawl net under a T5 licence.

(3)For subsection (1), the regulated period is from 8a.m. to 6p.m.

Division 1A Southern inshore trawl region

86A   Possessing or using trawl nets in southern inshore trawl region

(1)A person must not possess or use a trawl net in the southern inshore trawl region in a regulated period.

(2)However, subsection (1) does not apply to a person possessing or using an otter trawl net under a T6, T7 or T8 licence.

(3)For subsection (1), each of the following is a regulated period—

(a)from midday on 20 September to midday on 1 November;

(b)from midday on 23 December to midday on 3 January.

5   Amendment of s 110A (Saucer scallops in particular waters in particular period)

Section 110A, from ‘region A’—
omit, insert—

region A and the southern offshore trawl region B from midday on 1 May to midday on 20 January.

6   Amendment of sch 1 (Regulated waters)

(1)Schedule 1, part 2, after entry for southern regional waters—
insert—

southern offshore trawl region B	waters within the southern offshore trawl region B	section 86
southern offshore trawl region A	waters within the southern offshore trawl region A	section 86

(2)Schedule 1, part 2, after entry for Great Sandy Strait—
insert—

southern inshore trawl region waters within the southern inshore trawl region section 86A

7   Amendment of sch 2 (Regulated fish declarations)

Schedule 2, part 2, entry for saucer scallop, before first row—
insert—

1  a person taking the fish in the southern inshore trawl region or the central trawl region

2  a person possessing the fish on a commercial fishing boat in the southern inshore trawl region or the central trawl region, other than if—

(a)  the person is using the boat to travel through the trawl region; and

(b)  the boat moves at a speed of at least 5 knots
