Fisheries (Rock Lobster) Amendment Rules 2015

I make the following rules under the Living Marine Resources Management Act 1995 .12 October 2015

1Short titleThese rules may be cited as the Fisheries (Rock Lobster) Amendment Rules 2015 . 2CommencementThese rules take effect on the day on which their making is notified in the Gazette. 3Principal RulesIn these rules, the Fisheries (Rock Lobster) Rules 2011 are referred to as the Principal Rules. 4Rule 3 amended (Interpretation) Rule 3 of the Principal Rules is amended by inserting ", with the exception of Flinders Island, Cape Barren Island and Bruny Island" after "definition" in paragraph (b) of the definition of eastern region . 5Rule 32 amended (Daily bag limit in eastern region) Rule 32 of the Principal Rules is amended by omitting "3 rock lobster" and substituting "2 rock lobster". 6Rule 33 amended (Possession limits) Rule 33 of the Principal Rules is amended as follows: (a) by omitting from subrule (4) "6 rock lobster" and substituting "4 rock lobster"; (b) by omitting from subrule (5) "6 rock lobster" and substituting "4 rock lobster"; (c) by omitting "6 rock lobster" from the definition of excess rock lobster in subrule (7) and substituting "4 rock lobster". 7Rule 34 amended (Boat limits) Rule 34 of the Principal Rules is amended as follows: (a) by omitting from subrule (3) "the fishing trip is one not exceeding 24 hours in duration and"; (b) by omitting from subrule (3)(a) "15 rock lobster" and substituting "10 rock lobster"; (c) by omitting subrule (4) .

EXPLANATORY NOTE

(This note is not part of the rule) These rules amend the

(a) setting a lower daily bag limit and lower possession limits for the non-commercial fishery in the eastern region; and (b) setting new boat limits for the non-commercial fishery in the eastern and western regions, being boat limits that are generally lower and will apply regardless of the duration of a fishing trip; and (c) adjusting the definition of ‘eastern region’.
