Fisheries Levy (East Coast Tuna Longline Fishery) Regulations 2(Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Fisheries Levy Act 1984.

1.   Amendment

1.1   The Fisheries Levy (East Coast Tuna Longline Fishery) Regulations are amended as set out in these Regulations.

 

[NOTE: These Regulations commence on gazettal: see Acts Interpretation Act 1901, s.48.]

2.   Regulation 3 (Interpretation)

2.1   Omit the definition of “notice”, substitute:

‘Fisheries Notice No. TEC 5’ means Fisheries Notice No. TEC 5, published in the Gazette on 11 July 1991 and in force under section 8 of the Fisheries Act 1952;

‘Fisheries Notice No. TEC 8’ means Fisheries Notice No. TEC 8, published in the Gazette on 11 December 1991 and in force under section 8 of the Fisheries Act 1952;”.

3.   Regulation 4 (Prescribed classes of endorsement—paragraph 5 (b) of the Act)

3.1   Omit paragraphs 4 (a), (b), and (c), substitute:

  • “(a)

    endorsements of the kind referred to in paragraph 6 (a) of Fisheries Notice No. TEC 5;

  • (b)

    endorsements of the kind referred to in paragraph 6 (b) of Fisheries Notice No. TEC 5;

  • (c)

    endorsements of the kind referred to in paragraph 6 (c) of Fisheries Notice No. TEC 5;

  • (d)

    endorsements of the kind referred to in paragraph 6 (d) of Fisheries Notice No. TEC 5;

  • (e)

    endorsements of the kind referred to in paragraph 5 (a) of Fisheries Notice No. TEC 8;

  • (f)

    endorsements of the kind referred to in paragraph 5 (b) of Fisheries Notice No. TEC 8;

  • (g)

    endorsements of the kind referred to in paragraph 5 (c) of Fisheries Notice No. TEC 8.”.

4.   Regulation 5 (Amounts of levy)

4.1   Omit paragraphs 5 (a) and (b), substitute:

  • “(a)

    for endorsement of a licence included in the class of endorsements prescribed in paragraph 4 (a)—$2,000;

  • (b)

    for endorsement of a licence included in the class of endorsements prescribed in paragraph 4 (b)—$2,000;

  • (c)

    for endorsement of a licence included in the class of endorsements prescribed in paragraph 4 (c)—$1,000;

  • (d)

    for endorsement of a licence included in the class of endorsements prescribed in paragraph 4 (d)—no levy;

  • (e)

    for endorsement of a licence included in the class of endorsements prescribed in paragraph 4 (e)—$2,000;

  • (f)

    for endorsement of a licence included in the class of endorsements prescribed in paragraph 4 (f)—$1,000;

  • (g)

    for endorsement of a licence included in the class of endorsements prescribed in paragraph 4 (g)—$1,000.”.3
