Fisheries Research and Development Corporation Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Primary Industries Research and Development Corporations Act 1989.

1.   Commencement

1.1   These Regulations are taken to have commenced on 1 July 1994.

2.   Amendment

2.1   The Fisheries Research and Development Corporation Regulations are amended as set out in these Regulations.

3.   Regulation 4A (Levies attached to the Corporation)

3.1   Paragraph 4A (1) (c):

Omit the paragraph, substitute:

• “(c)

  a levy of the kind referred to in:

  • (i)

    paragraph 5 (1) (b) of the Fisheries Agreements (Payments) Act 1991; or

  • (ii)

    subsection 36 (1) of the Fisheries Management Act 1991.”.

3.2   Subregulation 4A (2):

Omit the subregulation, substitute:

 “(2) For the purposes of paragraph 5 (3) (a) of the Act, the research component of a levy referred to in subregulation (1) for the financial year commencing on 1 July 1994 is:

• (a)

  in the case of levy imposed by section 5 of the Fisheries Levy Act 1984—5.95%; and

• (b)

  in the case of levy imposed by section 5 of the Fishing Levy Act 1991—11.12%; and

• (c)

  in the case of a levy referred to in paragraph (1) (c)—1.54%.”.
