Fisheries Research and Development Corporation Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Primary Industries and Energy Research and Development Act 1989.

1.   Commencement

1.1   These Regulations (other than regulation 4) are taken to have commenced on 1 July 1995.

[NOTE: Regulation 4 commences on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   Amendment

2.1   The Fisheries Research and Development Corporation Regulations are amended as set out in these Regulations.

3.   Regulation 4A (Levies attached to the Corporation)

3.1   Paragraph 4A (1) (a):

Omit the paragraph.

3.2   Subregulation 4A (2):

Omit “1994”, substitute “1995”.

3.3   Paragraph 4A (2) (a):

Omit the paragraph.

3.4   Paragraph 4A (2) (b):

Omit “11.12%;”, substitute “6.93%;”.

3.5   Paragraph 4A (2) (c):

Omit “1.54%.”, substitute “2.90%.”.

4.   New regulation 4D

4.1   After regulation 4C, insert:

Gross value of production of State or Territory managed fisheries

 “4D.For the purposes of subsection 30A (5) of the Act, the Minister is to determine a State or Territory GVP for a financial year in accordance with the formula:

where:

 C is the sum of the gross value of production of the goods that are the produce of that part of the fishing industry concerned with taking or culturing fish or fish products managed by or on behalf of that State or Territory for the 3 immediately preceding financial years.”.
