Fisheries Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulation under the Fisheries Act 1952.

Penalties

The Fisheries Regulations are amended as set out in the Schedule.

SCHEDULE

AMENDMENTS RELATING TO PENALTIES

Sub-regulation 8 (4)—

Omit “Penalty: $200.”, substitute the following:

“Penalty—

(a) in the case of a natural person—$2,000; or

(b) in the case of a body corporate—$10,000.”.

Sub-regulation 11 (2)—

Omit “shall each be deemed to be guilty of an offence against this regulation punishable on conviction by a fine not exceeding $200”, substitute the following:

“are each guilty of an offence punishable on conviction by a fine not exceeding—

(d) in the case of a natural person—$2,000; or

(e) in the case of a body corporate—$10,000”.

Sub-regulation 12c (1)—

Omit “$200”, substitute “$2,000”.

 

Sub-regulation 12d (1)—

Omit “$200”, substitute “$2,000”.

Sub-regulation 12e (1)—

Omit “$200”, substitute “$2,000”.

Sub-regulation 12f (2)—

Omit “$200”, substitute “$2,000”.

Sub-regulation 12g (4)—

Omit “$200”, substitute “$2,000”.

Sub-regulation 12k (3)—

Omit “Penalty: $200.”, substitute the following: “Penalty—

(a) in the case of a natural person—$2,000; or

(b) in the case of a body corporate—$10,000.”.

Sub-regulation 12l (1)—

Omit “$200”, substitute “$2,000”.

Regulation 12m—

Omit “$200”, substitute “$2,000”.

Sub-regulation 13 (1)—

Omit “$200”, substitute “$2,000”.

Sub-regulation 13a (2)—

Omit “$200”, substitute “$100”.

Sub-regulation 15 (1)—

Omit “Penalty: $200.”, substitute the following: “Penalty—

(a) in the case of a natural person—$2,000; or

(b) in the case of a body corporate—$10,000.”.

Regulation 18—

Omit “$200” (wherever occurring), substitute “$2,000”.

Sub-regulation 19 (1)—

Omit “$200”, substitute “$500”.
