Fisheries Regulations2 (Amendment)

I, THE ADMINISTRATOR of the Government of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Fisheries Act 1952.

Interpretation

1. Regulation 3 of the Fisheries Regulations is amended by inserting the following definitions in their respective appropriate alphabetical positions (determined on a letter-by-letter basis):

“ ‘KKFC Agreement’ means the Agreement between the Commonwealth and the K.K.F.C Proprietary Limited signed on 28 July 1986 and published by the Department;

‘Subsidiary Agreement’ means the Subsidiary Agreement between the Government of Australia and the Government of Japan concerning Japanese Tuna Long-line Fishing signed on 30 October 1986 and published by the Department;”.

Applications for licences

2. Regulation 5 of the Fisheries Regulations is amended by omitting from subregulation (3) “Industry” and substituting “Industries and Energy”.

Prescribed person: paragraph 13ab (3) (b) of the Act

3. Regulation 12a of the Fisheries Regulations is amended:

(a) by omitting “Australian Coastal” and substituting “Federal Sea Safety and”; and

(b) by inserting “and Communications” after “Transport”.

 

Masters of foreign boats in the Australian fishing zone to furnish position reports

4. Regulation 12c of the Fisheries Regulations is amended:

(a) by omitting from subregulation (1) “Australian Coastal” and substituting “Federal Sea Safety and”;

(b) by inserting in subregulation (1) “and Communications” after “Transport”; and

(c) by omitting from subregulation (3) “Australian Coastal” and substituting “Federal Sea Safety and”.

Short methods of reference

5. Regulation 21 of the Fisheries Regulations is amended by omitting subregulation (1).

Repeal

6. Schedules 3 and 4 to the Fisheries Regulations are repealed.

Schedule 5

7. Schedule 5 to the Fisheries Regulations is amended by omitting items 5 and 6 and substituting the following item:

“5 ‘authorised area of the Australian fishing zone for Taiwanese vessels’

The part of the Australian fishing zone described in Appendix A to the KKFC Agreement in which duly licensed vessels of the Kaohsiung Fishing Boat Commercial Guild may take fish by use of the pair trawling method of fishing”.
