Fisheries Quota Declaration 2019
1 Short title
This declaration may be cited as the Fisheries Quota Declaration 2019.
2 Commencement
This declaration commences on 28 May 2019.
3 Application of declaration
(1)This declaration declares total quota entitlements for particular fisheries, or particular parts of a fishery, for section 37 of the Act.(2)Unless this declaration provides otherwise, terms used in it have the meaning given under the Fisheries (General) Regulation 2019.(3)Subsection (2) is not limited to a term defined under the Fisheries (General) Regulation 2019 but also applies to a provision of the regulation that aids the interpretation of a term mentioned in the regulation.Note—
See, for example, section 11 of that regulation in relation to references to quota authorities by name.
4 Total quota entitlements
(1)The total quota entitlement for a commercial fishery, or a part of a commercial fishery, mentioned in schedule 1 for fish mentioned in column 1 of the schedule is the amount stated opposite the fish in column 2.(2)The total quota entitlement applies to—(a)for fish taken in the commercial trawl fishery (fin fish)—each calendar year; or(b)for fish taken in another commercial fishery or a part of another commercial fishery—each quota year, as defined in the Fisheries (Commercial Fisheries) Regulation 2019, section 107, for the quota authority authorising the taking of the fish in the fishery or the part of the fishery.(3)A reference to a part of a commercial fishery in schedule 1 by name is a reference to the part of the fishery of that name described in a fishery provision about the fishery.
