1 Name
This instrument is the Fisheries Management (Southern and Eastern Scalefish and Shark Fishery Total Allowable Catch – Quota Species) Fishing Capacity Determination 2018.
2 Commencement
This instrument commences on the day after it is registered on the Federal Register of Legislation.
3 Cessation
This instrument is repealed on 1 May 2019 unless earlier revoked.
4 Authority
This instrument is made pursuant to paragraph 17(6)(aa) of the Fisheries Management Act 1991 under section 11 of the Southern and Eastern Scalefish and Shark Fishery Management Plan 2003.
5 Definitions
Note: A term used in this instrument that is defined for the purposes of the:
(a) Fisheries Management Act 1991 has the same meaning in this instrument as it has in that Act
(b) Southern and Eastern Scalefish and Shark Fishery Management Plan 2003 has the same meaning in this instrument as it has in that Plan.
In this instrument:
East and West in the table in clause 6, in relation to the species ‘Deepwater shark’ mean:
(a) East – the Gemfish eastern zone, as defined in Schedule 1, Part 3 section 1 of the Southern and Eastern Scalefish and Shark Fishery Management Plan 2003.
(b) West – the Gemfish western zone, as defined in Schedule 1, Part 3 section 2 of the Southern and Eastern Scalefish and Shark Fishery Management Plan 2003.
Cascade Plateau and Other in the table in clause 6, in relation to the species ‘Smooth oreo dory’ mean:
(a) Cascade Plateau – the orange roughy Cascade Plateau zone of the fishery, as defined in clause 4 of Part 3 of Schedule 1 of the Southern and Eastern Scalefish and Shark Fishery Management Plan 2003.
(b) Other – areas of the fishery outside the orange roughy Cascade Plateau zone of the fishery, as defined in clause 4 of Part 3 of Schedule 1 of the Southern and Eastern Scalefish and Shark Fishery Management Plan 2003.
6 Determination of total allowable catch
The total allowable catch for each quota species in the fishery for the 2018 fishing year commencing on 1 May 2018 and ending on 30 April 2019 is:
