1  Name

This instrument is the Fisheries Management (Small Pelagic Fishery) Fishing Method Determination 2018.

2  Commencement

This instrument commences on 1 May 2018.

3  Authority

This instrument is made pursuant to subsection 17(6)(aa) of the Fisheries Management Act 1991 under section 27(1) of the Small Pelagic Fishery Management Plan.

4  Definitions

Note:          A term used in this instrument that is defined for the purposes of the:

(a)   Fisheries Management Act 1991 has the same meaning in this instrument as it has in that Act

(b)     Small Pelagic Fishery Management Plan 2009 has the same meaning in this instrument as it has in that Plan.

In this instrument:

‘Jigging’ means fishing using a motorised jigging machine.

‘Jigging machine’ means a device consisting of one or more jig lines, to which barbless lures or hooks are attached, that are rotated on elliptical spools by an electric motor.

‘Minor line’ means a device consisting of one or more hooks that is used in minor line fishing.

‘Minor line fishing’ means trolling, or fishing using a rod and reel, handline or pole.                 

5  To whom this instrument applies

This instrument applies to the holder of a Statutory Fishing Right in the Small Pelagic Fishery and to a person acting on behalf of the holder.

6  Determination of fishing method

Commencing on the day after this instrument is registered the fishing methods known as jigging and minor line methods may be used by persons, otherwise authorised, to fish in the Small Pelagic Fishery.
