Fisheries Management Regulations (Amendment) (Cth)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the
Federal Executive Council, make the following Regulations under the
Dated 29 May 1996.

1.1 The Fisheries Management Regulations are amended as set out in these Regulations.
[Note: These Regulations commence on gazettal: see
2.1 Omit the regulation, substitute:
“
(a) an Australian boat; or
(b) a foreign boat in the AFZ;
south of the parallel of Latitude 30° South unless there is attached to the boat, in relation to each point at which hooks, connected directly or indirectly to the longline, enter the water:
(c) a Tori Pole apparatus, in accordance with Schedule 3D; or
(d) if the person is the holder of a scientific permit under section 33 of the Act that permits the use, in that area, of another apparatus instead of a Tori Pole apparatus—an apparatus that complies with the permit.
Maximum penalty: 10 penalty units.”.
3.1 Subparagraph 4 (d) (ii):
Omit the subparagraph, substitute:
“(ii) each streamer in the streamer pair that is positioned the greatest distance from the boat is:
(A) if the boat is an Australian boat—at least 1 metre long; or
(B) if the boat is a foreign boat—at least 3.5 metres long; and”.
