Fisheries Management Regulations2 (Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Fisheries Management Act 1991.

1.   Commencement

1.1   Regulation 5 commences on 1 May 1997.

[NOTE:   The remaining provisions of these Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   Amendment

2.1   The Fisheries Management Regulations are amended as set out in these Regulations.

3.   Regulation 21 (Fees)

3.1   Add at the end:

 “(3) Despite subregulation (1), no fee is payable for an application mentioned in item 13 of Schedule 2 if:

• (a)

  the application is made in the period beginning on 1 July 1997 and ending at the end of 30 April 1998; and

• (b)

  the applicant was the holder of a fish receiver permit on 30 June 1997.”.

4.   Regulation 36 (Secrecy)

4.1   Subregulation 36 (1):

Omit “Subject to this regulation, a”, substitute “A”.

4.2   Subregulation 36 (2):

Omit the subregulation, substitute:

 “(2) However, a person may do an activity mentioned in paragraph (1) (a), (b) or (c) if the activity is done in accordance with:

• (a)

  the Act, the Fisheries Administration Act 1991 or these Regulations; or

• (b)

  an order of:

  • (i)

    a court; or

  • (ii)

    a tribunal; or

  • (iii)

    a person having authority, under a law, or with the consent of parties, to receive evidence.”.

5.   Schedule 2 (Fees)

5.1   Schedule 2 is amended in accordance with the following table:
