Fisheries Management Regulations2 (Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Fisheries Management Act 1991.

1.   Commencement

1.1   These Regulations commence on 1 October 1997.

2.   Amendment

2.1   The Fisheries Management Regulations are amended as set out in these Regulations.

3.   Regulation 4C (Eastern Tuna and Billfish Fishery—sectors, etc)

3.1   Paragraph 4C (1) (b):

Omit the paragraph.

4.   Regulation 10B (Returns—South East Trawl Fishery, South East Non-trawl Fishery and Southern Bluefin Tuna Fishery)

4.1   Subregulation 10B (2):

Add at the end:

• “; (d)

  fishing in the South East Non-trawl Fishery;”.

4.2   Paragraph 10B (3) (a):

Omit the paragraph, substitute:

• “(a)

  contain the particulars mentioned in subregulation (4); and”.

4.3   After subregulation 10B (3), insert:

 “(4) For paragraph (3) (a), the particulars are:

• (a)

  the information included in the record kept under regulation 10AA; and

• (b)

  a declaration by a person mentioned in paragraph (3) (c) that the person has observed the weighing of each species of fish received; and

• (c)

  a declaration of the weights observed.”.

5.   Schedule 1A (Area of fisheries)

5.1   After Part 3, insert:

PART 3A—HEARD ISLAND AND McDONALD ISLANDS FISHERY

That part of the AFZ within the area bounded by a line:

• (a)

  beginning at the intersection of the meridian of longitude 60° east and the parallel of latitude 53° 14' south; and

• (b)

  running:

  • (i)

    from there east along that parallel to its intersection with the meridian of longitude 67° 03' east; and

  • (ii)

    from there north-easterly along the geodesic to the intersection of the parallel of latitude 49° 24' south and the meridian of longitude 76° 42' east; and

  • (iii)

    from there easterly along the parallel to the intersection with the meridian of longitude 80° east; and

  • (iv)

    from there south along that meridian to its intersection with the parallel of latitude 55° south; and

  • (v)

    from there west along that parallel to its intersection with the meridian of longitude 60° east; and

  • (vi)

    from there north along that meridian to the point where the line began.

6.   Schedule 1A, Part 6 (Area of the North West Slope Trawl Fishery)

6.1   Omit the Part, substitute:

PART 6—AREA OF THE NORTH WEST SLOPE FISHERY

That part of the AFZ within the area bounded by a line:

• (a)

  beginning at the intersection of the meridian of longitude 114° 00' east by the parallel of latitude 21° 37' south; and

• (b)

  running:

  • (i)

    from there north-westerly along the geodesic to the outer limit of the AFZ; and

  • (ii)

    from there north-easterly along the outer limit of the AFZ to the point of latitude 13° 13' south, longitude 118° 29' east; and

  • (iii)

    from there generally south-easterly along the geodesic to the point of latitude 13° 56' south, longitude 120° 01' east; and

  • (iv)

    then generally north-easterly along the geodesic to the point of latitude 13° 15' south, longitude 121° 49' east; and

  • (v)

    then generally north-easterly along the geodesic to the point of latitude 12° 30' south, longitude 123° 06' east; and

  • (vi)

    from there along a line each point of which is twelve miles distant from the nearest base point of the territorial sea of Ashmore Island to the point 12° 19' south, longitude 123° 21' east; and

  • (vii)

    from there generally north-easterly along the geodesic to the point of latitude 11° 55' south, longitude 125° 00' east; and

  • (viii)

    from there south-westerly along the geodesic to the point of latitude 13° 19' south to its intersection by the meridian of longitude 124° 00' east; and

  • (ix)

    from there west along the geodesic to the point of latitude 13° 19' south, longitude 123° 49' east; and

  • (x)

    from there south-westerly along the geodesic to the point of latitude 13° 35' south, longitude

    123° 37' east; and

  • (xi)

    from there south-westerly along the geodesic to the point of latitude 14° 00' south, longitude

    123° 36' east; and

  • (xii)

    from there south-westerly along the geodesic to the point of latitude 14° 03' south, longitude

    123° 25' east; and

  • (xiii)

    from there south-westerly along the geodesic to the point of latitude 14° 13' south, longitude

7.1   Omit the Part, substitute:
