s7 6 s7 Fisheries Management Plans Amendment Management Plan (No. 5) 2003 No. 379, 2003 ‘Division 2—Grey nurse shark protection area closures ‘Subdivision 1—Schedule 3A, part 1 ‘8A Closures—sch 3A, pt 1 ‘ (1) The waters mentioned in schedule 3A, part 1 are closed waters. ‘ (2) The waters are closed every year, all year. ‘8B Prohibited activities ‘ (1) This section applies to everybody. ‘ (2) The following activities are prohibited— (a) taking coral reef ﬁn ﬁsh from closed waters under this subdivision; (b) possessing coral reef ﬁn ﬁsh taken in contravention of paragraph (a). ‘Subdivision 2—Schedule 3A, part 2 ‘8C Closures—sch 3A, pt 2 ‘ (1) The waters mentioned in schedule 3A, part 2 are closed waters. ‘ (2) The waters are closed every year, all year. ‘8D Prohibited activities—commercial ﬁshers acting under ‘A1’ or ‘A2’ ﬁshery symbol ‘ (1) This section applies to commercial ﬁshers acting under the ﬁshery symbol ‘A1’ or ‘A2’. ‘ (2) The following activities are prohibited— (a) taking coral reef ﬁn ﬁsh in closed waters under this subdivision from 6 p.m. to 6 a.m. on any day;

s8 7 s9 Fisheries Management Plans Amendment Management Plan (No. 5) 2003 No. 379, 2003 (b) using a ﬁshing line or cast net to take coral reef ﬁn ﬁsh in closed waters under this subdivision from 6 a.m. to 6 p.m. on any day; (c) possessing a ﬁsh taken in contravention of paragraph (a) or (b). ‘8E Prohibited activities—other ﬁshers ‘ (1) This section applies to everybody other than commercial ﬁshers acting under the ﬁshery symbol ‘A1’ or ‘A2’. ‘ (2) The following activities are prohibited— (a) taking coral reef ﬁn ﬁsh from closed waters under this subdivision; or (b) possessing coral reef ﬁn ﬁsh taken in contravention of paragraph (a).’. 8 Amendment of sch 3, hdg Schedule 3, heading, after ‘ FOR ’— insert — ‘ ANNUAL ’. 9 Insertion of new sch 3A After schedule 3— insert —

s 16 13 s 16 Fisheries Management Plans Amendment Management Plan (No. 5) 2003 No. 379, 2003 (c) using more than 4 permitted apparatus at a time to take spanner crab in closed waters under this division from 6 a.m. to 6 p.m. on any day; (d) possessing a spanner crab taken in contravention of paragraph (a), (b) or (c). ‘8F Permitted apparatus for recreational ﬁshers ‘ (1) For section 8E(2)(b) and (c), a dilly that complies with subsections (2) to (5) is a permitted apparatus. ‘ (2) The dilly must have— (a) an area within its frame of no more than 1 m 2 ; and (b) a net drop below its frame of no more than 10 cm. ‘ (3) The dilly’s net must have square or rectangular meshes. ‘ (4) The mesh size of the net must be at least 25 mm. ‘ (5) The dilly must have attached to it— (a) a tag with the owner’s full name and address on it; and (b) a light coloured ﬂoat that— (i) is at least 15 cm in each of its dimensions; and (ii) has the owner’s full name on it.’. 16 Amendment of s 67 (Application of pt 6) Section 67— insert — ‘ (2) However, this part does not apply to spanner crabs taken in closed waters under part 2A, division 2. 8 ’. 8 Part 2A (Closed waters declaration), division 2 (Schedule 2A, part 2)
