I, PHILIP MICHAEL JEFFERY, Governor‑General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Fisheries Management Act 1991.

  1. Name of Regulations

These Regulations are the Fisheries Management (Macquarie Island Toothfish Fishery) Regulations 2006.

  1. Commencement

These Regulations commence on the day after they are registered.

  1. Interpretation

(1)In these Regulations:

Act means the Fisheries Management Act 1991.

Management Plan means the Macquarie Island Toothfish Fishery Management Plan 2006.

(2)In these Regulations, the following expressions have the same meaning as they have in the Management Plan:

(a)fishery;

(b)fishing year;

(c)holder;

(d)owner;

(e)statutory fishing right.

Note The following expressions are defined in the Act and, unless the contrary intention appears, have the meaning they have in the Act: see paragraph 13 (1) (b) of the Legislative Instruments Act 2003:

(a)AFMA;

(b)Register;

(c)take.

  1. Details to be included in Register (Act s 45)

(1)In this regulation:

contact and SFR information, in relation to a person, means:

(a)the name of the person; and

(b)if the person is a company — the ACN (within the meaning given by section 9 of the Corporations Act 2001) of the company; and

(c)the person’s postal address, email address, and telephone and fax numbers; and

(d)if the person is the owner of a statutory fishing right — the number of rights the person owns; and

(e)if the person is the holder, but not the owner, of a right — the number of rights the person holds; and

(f)the total weight, in kilograms, of fish that may be taken each fishing year under the rights mentioned in paragraph (d) or (e).

(2)For paragraph 45 (1) (f) of the Act, AFMA must enter in the Register, for each statutory fishing right granted for the fishery:

(a)the owner’s contact and SFR information; and

(b)if the owner of the right is not the holder of the right — the holder’s contact and SFR information.

(3)AFMA may alter the Register to reflect a change in information mentioned in subregulation (2).

(4)For paragraph 1 (c), the postal address, email address, and telephone and fax numbers of a person that is an owner or holder are the addresses and numbers most recently notified to AFMA by the owner or holder.
