under the
Fisheries Management Act 1994
His Excellency the Lieutenant-Governor, with the advice of the Executive Council, has made the following Regulation under the Fisheries Management Act 1994.

Explanatory note
The object of this Regulation is to convert a number of fishing closures that currently have effect under section 8 of the Fisheries Management Act 1994 for a period of up to 5 years to permanent prohibitions under that Act.
In particular, the Regulation amends a number of regulations to make provision for or with respect to the following:
| (a) | restricting certain classes of commercial and recreational fishing using various methods in specified areas and during specified periods, |
| (b) | prohibiting spearfishing in certain waters, |
| (c) | prescribing certain conditions of permits for research and other purposes, |
| (d) | providing for certain daily bag limits in respect of specified fish species, |
| (e) | providing for the manner in which pipis may be taken, |
| (f) | prohibiting the taking of bluefish, |
(g) protecting southern bluefin tuna from commercial fishing,
This Regulation is made under the Fisheries Management Act 1994, including sections 17,
18, 19, 20, 21, 37, 40, 60, 68 and 289 (the general regulation-making power).

1 Name of Regulation
This Regulation is the Fisheries Management Legislation Amendment
(Fishing Closures) Regulation 2008.
2 Amendment of Fisheries Management (General) Regulation 2002
The Fisheries Management (General) Regulation 2002 is amended as set out in Schedule 1.
3 Amendment of other Fisheries Management legislation
The Regulations specified in Schedule 2 are amended as set out in that
Schedule.

(2) For the purposes of section 21 (1) (d) of the Act, it is a defence to a prosecution for an offence under section 19 of the Act constituted by taking or being in possession of bluefish if the person charged satisfies the Court that:
(a) the bluefish were taken from Lord Howe Island waters, and (b) the person’s possession of the fish would, but for the fish being protected fish, be lawful.

8B Prohibited classes of fishing—recreational and inland restricted
fishery
(1) A person must not engage in a prohibited class of recreational or
commercial (inland) fishing.
Maximum penalty: 100 penalty units.

(2) A person engages in a prohibited class of recreational or commercial (inland) fishing if the person takes, from an area specified in column 1 of Schedule 2, fish of a kind specified next to that area in column 2 of that Schedule using a method specified next to that area in column 3 of that Schedule during the period or periods specified in column 4 of that Schedule. (3) Except as otherwise provided by this clause, this clause does not apply in respect of a commercial fisher taking fish for sale as authorised under the Act. (4) This clause extends to a commercial fisher taking fish in the
inland restricted fishery.

(5) In this clause, the authorised area for the taking of pipis is the
area within 50 metres of the mean high water mark of a beach.

(1) For the purposes of section 68 (6A) of the Act, it is a condition of a meshing endorsement that any fish taken at any time that are to be released in the period starting one hour before sunrise and ending one hour after sunset are released:
(a) using a discard chute that complies with discard chute guidelines, and (b) in a manner that complies with the discard chute guidelines. (2) For the purposes of this clause, discard chute guidelines are guidelines approved by the Director-General for the purposes of this clause and published in the Gazette.

9A Taking of female spanner crab (seasonal restriction) For the purposes of section 20 (2) of the Act, it is declared that the class of commercial fishing that consists of the taking of female spanner crab (Ranina ranina) from the waters of the fishery is prohibited during the period from 21 October in any year to 20 January in the following year (both dates inclusive).
9B Taking of male spanner crab (seasonal restriction) For the purposes of section 20 (2) of the Act, it is declared that the class of commercial fishing that consists of the taking of male spanner crab (Ranina ranina) from the waters of the fishery is prohibited during the period from 21 November to 20 December in each year (both dates inclusive).

For the purposes of section 17 (1) of the Act, the daily limit of a species of fish described in Column 1 of Schedule 3 is, when the fish are taken from waters specified opposite that species of fish in Column 4 of that Schedule and the person taking the fish falls within the class of endorsement holders specified next to the species in Column 3 of that Schedule, the quantity specified next to that species in Column 2 of that Schedule.
(2)
For the purposes of section 18 (1) of the Act, the possession limit of fish of a species described in Column 1 of Schedule 3 is, when the fish are taken from waters specified opposite that species of fish in Column 4 of that Schedule and the person in possession of that species of fish falls within the class of endorsement holders specified next to the species described in Column 3 of that Schedule, the quantity specified next to that species in Column 2 of that Schedule.
(3)
For the purposes of section 21 (1) (d) of the Act, it is a defence to a prosecution for an offence under section 18 (2) of the Act that is constituted by being in possession of fish in contravention of a possession limit imposed by this Plan if the person charged
