Name of Proclamation
This Proclamation is the Fisheries Management (Excepted Waters) Proclamation 2011.
Commencement
This Proclamation commences on the day after it is registered.
Definitions
In this Proclamation:
AGD66, short for Australian Geodetic Datum 1966, means the coordinate system for Australia, published by the Department of National Development, National Mapping Council, in the Commonwealth of Australia Gazette, No. 84, dated 6 October 1966.
nautical mile means an international nautical mile, being 1 852 metres.
Treaty means the Treaty between Australia and the Independent State of Papua New Guinea concerning sovereignty and maritime boundaries in the area between the two countries, including the area known as Torres Strait, and related matters, done at Sydney on 18 December 1978.
WGS84, short for World Geodetic System 1984, means the geodetic reference system defined by the US National Imagery and Mapping Agency, Technical Report — NIMA TR8350.2 Third Edition (including amendments to 23 June 2004) — Department of Defence World Geodetic System 1984 — Its Definition and Relationships with Local Geodetic Systems, in particular Chapters 2.2.1 and 7.
Excepted waters — Torres Strait
(1) For section 11 of the Fisheries Management Act 1991, excepted waters, for the Torres Strait, include all waters contained within the line:
(a) commencing at the intersection of the westernmost boundary of the Protected Zone, under Annex 9 of the Treaty, by the Fisheries Jurisdiction Line, under Annex 8 of the Treaty; and
(b) from the intersection mentioned in paragraph (a), generally north‑easterly, north, north-easterly, easterly, south-easterly, easterly, south, easterly, north-easterly, easterly and south-easterly, along the Fisheries Jurisdiction Line to its intersection by the easternmost boundary of the Protected Zone; and
(c) from the intersection mentioned in paragraph (b), generally south, south-westerly, west and north along the Protected Zone boundary line, to the point of commencement.
(2) Part 1 of Schedule 1:
(a) describes the geographic coordinates for intersection points and specific lines mentioned in subsection (1), in terms of WGS84; and
(b) is the authoritative transformation between AGD66, used in the Treaty, and WGS84.
Note 1 The points are defined by the conversion from AGD66 to the Geocentric Datum of Australia 1994 (GDA94) and from GDA94 to the International Terrestrial Reference Frame 2000 (ITRF00), which is deemed to be equivalent to WGS84.
Note 2 See the diagram in Part 2 of Schedule 1 for a general illustration of the line specified in Part 1 of Schedule 1.
(3) For this Proclamation:
(a) reliance on the information provided in Part 1 of Schedule 1 is evidence of any matter relating to the area of the excepted waters of the Torres Strait; and
(b) the location of a point mentioned in Part 1 of Schedule 1 is determined by the geographic coordinates, and by reference to the geodetic datum.
Excepted waters — Australian Antarctic Territory
For section 11 of the Fisheries Management Act 1991, excepted waters, for the Australian Antarctic Territory, include all waters within 200 nautical miles seaward of the territorial sea baselines of the Australian Antarctic Territory established under international law.
Guide to reading Part 1 of Schedule 1
In Part 1 of Schedule 1:
(a) lines are specified by reference to points; and
(b) the columns of an item in a table in which a point is specified set out information about the point; and
(c) the information about the point states:
(i) the point identifier shown in the first column of an item in the table; and
