FISHERIES MANAGEMENT ACT 1994—REGULATION

(Relating to the use of fish traps)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Fisheries Management Act 1994, has been pleased to make the Regulation set forth hereunder.

The Fisheries Management (General) Regulation 1995 is amended by

inserting after clause 58 (1) (c) the following paragraph:

(d) The trap is not set or used unless it is secured or weighted so that the trap rests on the seabed. This condition has effect on and from 1 April 1996.

EXPLANATORY NOTE

The object of this Regulation is to prohibit, on and from 1 April 1996, the use of a
fish trap unless the fish trap is secured or weighted so that it rests on the seabed.

This Regulation is made under the Fisheries Management Act 1994, in particular section 23 (Regulations relating to fishing gear) and section 289 (the general regulation making power).
