FISHERIES MANAGEMENT ACT 1994—REGULATION
(Relating to the Ocean hauling restricted fishery)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Fisheries Management Act 1994, has been pleased to make the Regulation set forth hereunder.

Commencement
1. This Regulation commences on 1 March 1996.
Amendments
2. The Fisheries Management (General) Regulation 1995 is amended:
(a)
by omitting from clause 2 12O (3) (a) the matter “$30” and by inserting instead the matter “$250”;
(b)
by omitting from clause 212O (3) (b) the matter ``$20’’ and by inserting instead the matter “$50”.
EXPLANATORY NOTE
The object of this Regulation is to increase the application fee payable by the holder of a commercial fishing licence for an endorsement for a further period in the ocean hauling restricted fishery. An endorsement authorises the holder to take fish for sale in the restricted fishery. At present the fees are $30 for a class A endorsement (endorsement as a skipper) and $20 for a class B endorsement (endorsement as a crew member). The new fees are $250 and $50 respectively. The increase makes the fees for endorsement for a further period the same as the fees for a new endorsement in the restricted fishery.
This Regulation is made under the Fisheries Management Act 1994, in particular section 116 (which authorises regulations relating to restricted fisheries) and section 289 (the general regulation making power).
