FISHERIES MANAGEMENT ACT 1994—PROCLAMATION

I, Rear Admiral PETER ROSS SINCLAIR, A.C., Governor of the State of New South Wales, with the advice of the Executive Council, on the recommendation of the Minister for Agriculture and Fisheries, and in pursuance of section 42 of the Fisheries Management Act 1994, do, by this my Proclamation, amend Schedule 1 to that Act by inserting before the note in that Schedule the following descriptions of fisheries:
Estuary general fishery
1. (1) Description of fishery. The estuary general fishery
consists of the following:
(a)
the use of relevant fishing gear to take any fish from estuarine waters;
(b)
the use of an otter trawl net (prawns) to take any fish from the Clarence River;
(c)
eels (Anguilla reinhardtii) and mud crab (Scylla serrata) taken by any method from any waters.
(2) In this clause, “relevant fishing gear” means any of the
following fishing gear:
(a) hauling net (general purpose);
(b) trumpeter whiting net (hauling);
(c) garfish net (bullringing);
(d) garfish net (hauling);
(e) pilchard, anchovy and bait net (hauling);
(f) purse seine net;
(g) prawn net (hauling);
(h) prawn net (set pocket);
(i) prawn running net;1995—No. 60
seine net (prawns);
meshing net;
flathead net;
bait net;
lampara net;
pound net;
submersible lift net (bait);
any kind of net that may lawfully be used by a person who
is not a commercial fisher;
fish trap;
crab trap;
bait trap;
set line;hand held line (including any rod and line or handline).
(3) In this clause, “estuarine waters” means waters ordinarily subject to tidal influence (other than ocean waters).
Estuary prawn trawl fishery
2. (1) Description of fishery. The estuary prawn trawl fishery
consists of the use of an otter trawl net (prawns) to take any fish
from any of the estuarine waters of the Hunter River, Hawkesbury
River, Port Jackson and Botany Bay.
(2) In this clause, “estuarine waters” means waters ordinarily subject to tidal influence (other than Ocean waters).
Ocean hauling fishery3. (1) Description of fishery. The Ocean hauling fishery consists of the use of a hauling net to take any fish from any of the following waters:
(a) Ocean waters within 3 nautical miles from coastal
baselines;
(b) the waters of Jervis Bay;
(c) the waters of Botany Bay east of a line drawn from Bear
Island generally southeast to the northernmost extremity of
Sutherland Point;
(d) the waters of Twofold Bay;
(e) the waters of Coffs Harbour.

(2) In this clause, “hauling net” means any of the following
hauling net (general purpose);
garfish net (hauling);
garfish net (bullringing);
pilchard, anchovy and bait net (hauling);
pound net.
Abalone fishery
4. Description of fishery. The abalone fishery consists of
abalone (Haliotis rubra) taken by any method from any waters.
Ocean trap and line fishery
5. ( 1 ) Description of fishery. The ocean trap and line fishery
consists of the following:
(a) the use of relevant fishing gear to take any fish from ocean waters;
(b) snapper (Pagrus auratus), yellowtail kingfish (Seriola lalandi) and spanner crab (Ranina ranina) taken by any
method from any waters.(2) In th is clause, “relevant fishing gear” means any of the
following fishing gear:
(a) fish trap;
(b) bait trap;
(c)
set lines and hand held lines (including pelagic or demersal lines, drop lines, rods and lines, handlines and trolled lines).
Lobster fishery
6. Description of fishery. The lobster fishery consists of
eastern rock lobster (Jasus verreauxi), southern rock lobster
(Jasus edwardsii) and tropical rock lobster (Panulirus longipes
and Panulirus ornatus) taken by any method from any waters.Ocean prawn trawl fishery
7. Description of fishery. The Ocean prawn trawl fishery consists of the use of an otter trawl net (prawns) to take any fish from any of the following waters:
(a) Ocean waters;
(b) the waters of Jervis Bay;
(c) the waters of Twofold Bay;
(d) the waters of Coffs Harbour.1995—No. 60
Ocean fish trawl fishery
8. Description of fishery. The Ocean fish trawl fishery consists of the use of an otter trawl net (fish) or a Danish seine trawl net (fish) to take any fish from Ocean waters south of a line drawn due
east from the lighthouse at Smoky Cape.Interpretation of descriptions of fisheries
9. Words and expressions used in this Schedule that are not
defined in this Act have the same meaning as they have in the
Fisheries Management (General) Regulation 1995.

EXPLANATORY NOTE
The object of this Proclamation is to identify certain fisheries as share management fisheries for the purposes of the Fisheries Management Act 1994 by inserting descriptions of the fisheries in Schedule 1 to that Act. At present, there are no share management fisheries described in the Schedule.
