His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Fisheries Management Act 1994.

Explanatory note

The objects of this Regulation are:

(a) to increase, from 50 penalty units ($5,000) to 100 penalty units ($10,000), the maximum fine for the offence of taking (or attempting to take) blue, brown or red groper by any method other than by the use of a rod and line or a handline (Schedule 1 [1]), and
(b) to increase the “on-the-spot” fine for the same offence from $300 to $500 (Schedule 1 [2]).

This Regulation is made under the Fisheries Management Act 1994, and, in particular, under sections 23 (Regulations relating to fishing gear), 276 (Penalty notices) and 289 (the general regulation-making power),

1 Name of Regulation

This Regulation is the Fisheries Management (General)

Amendment (Taking of Groper) Regulation 1997.

2 Commencement

This Regulation commences on 25 April 1997.

3 Amendment of Fisheries Management (General) Regulation 1995

The Fisheries Management (General) Regulation 1995 is amended as set out in Schedule 1.

4 Notes

The explanatory note does not form part of this Regulation.

Schedule 1 Amendments

(Clause 3)

[1]        Clause 77 Taking of groper

Omit the matter “Maximum penalty: 50 penalty units”.
Insert instead “Maximum penalty: 100 penalty units”.
