His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Fisheries Management Act 1994.

Explanatory note
At present, special endorsements are available in certain restricted fisheries which authorise a commercial fisher to take fish for sale in the restricted fishery while acting as a skipper of a boat. These endorsements are called skipper’s endorsements (formerly called temporary skipper’s endorsements) and conditional skipper’s endorsements.
The objects of this Regulation are:
(a) to change the eligibility requirements for those endorsements, and (b) to make skipper’s endorsements available in the purse seine net sector of the ocean hauling restricted fishery. This Regulation is made under the Fisheries Management Act 1994, including section 113 (2) (relating to eligibility for endorsements), section 116 (other regulations) and section 289 (the general regulation making power).

1 Name of Regulation
This Regulation is the Fisheries Management (General)
Amendment (Skippers) Regulation 1997.
2 Amendment of Fisheries Management (General) Regulation 1995
The Fisheries Management (General) Regulation 1995 is amended as set out in Schedule 1.

Omit “temporary” wherever occurring.
Clause 212R (1) (e)
Insert after clause 2 12R (1) (d):
(e) ocean hauling restricted fishery (but only in that part of the fishery that relates to the use of a purse seine net to take fish for sale).
[3] Clause 212R (3) (d)
Omit the paragraph.

Amendments Schedule 1 [4] Clause 212S Conditional skipper’s endorsement
Omit clause 212S (3) (b). Insert instead:
(b) the owner of the offshore prawn trawl boat agrees to give up any entitlement the owner has to any endorsement in the estuary general restricted fishery or the ocean hauling restricted fishery.
[5] Clause 212X Eligibility for an endorsement (owners of fishing businesses)
Insert after clause 212X (6):
(6A) The Director is to refuse to approve any nomination made in respect of a fishing business that is owned or partly owned by a person who holds a skipper’s endorsement under clause 212R in respect of a fishing business that is owned by another person.
