His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Fisheries Management Act 1994.

Explanatory note

At present, it is an offence under the Fisheries Management Act 1994 to be

in possession of a prohibited size fish or to sell a prohibited size fish.

Freezing, refrigerating or chilling a fish after capture may reduce the size of the fish. The object of this Regulation is to make it clear that if a fish is frozen, refrigerated or chilled, the size of the fish is to be determined in its frozen, refrigerated or chilled state.

This Regulation is made under the Fisheries Management Act 1994, including section 15 (Declaration of prohibited size fish) and section 289 (the general regulation making power).

1 Name of Regulation

This Regulation is the Fisheries Management (General)

Amendment (Prohibited Size Fish) Regulation 1996.

2 Commencement

This Regulation commences on 25 October 1996.

  1. Amendment of Fisheries Management (General) Regulation 1995

    The Fisheries Management (General) Regulation 1995 is amended as set out in Schedule 1.

The explanatory note does not form part of this Regulation.

Schedule 1 Amendment

(Clause 3)

Clause 7 Prohibited size fish

Insert after clause 7 (2):

(3) If a fish is frozen, refrigerated or chilled, the size of the
fish is to be determined as so frozen, refrigerated or
chilled.
