His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Fisheries Management Act 1994.

Explanatory note

At present, special conditions apply to any fishing boat licence that authorises the use of the boat for prawn trawling in the Clarence River. The object of this Regulation is to change those special licence conditions so as:

(a) to extend them to boats used for prawn trawling in Lake Woolooweyah, and
(b) to allow the size of a boat used for prawn trawling in the Clarence River or Lake Woolooweyah, or the engine of such a boat, to be increased by up to 10 per cent every ten years, and
(c) to require an approved form of by-catch reduction device to be used when a boat is used for prawn trawling in the Clarence River or Lake Woolooweyah, and
(d) to require prawns that are caught during such trawling to be graded immediately after each trawl and the sorted section of the catch to be returned to the water as soon as practicable.

The Regulation also prohibits the use of an otter trawl net (prawns) to take a prohibited size class of fish from the Clarence River or Lake Woolooweyah.

1      Name of Regulation

This Regulation is the Fisheries Management (General) Amendment
(Prawn Trawling) Regulation 2000.

2 Amendment of Fisheries Management (General) Regulation 1995

The Fisheries Management (General) Regulation 1995 is amended as set out in Schedule 1.

The explanatory note does not form part of this Regulation.

(Clause 2)

[1]      Clause 34 Otter trawl net (prawns)

Omit clause 34 (3) (b). Insert instead:

(b) the fish are a prohibited size class of fish (other than abalone or crustaceans), are not of a prohibited size and are taken in waters north of a line drawn due east from the lighthouse situated at Smoky Cape (excluding inland waters, the Clarence River and Lake Woolooweyah), or

Omit “and the Clarence River” from item 1 (a) of the Table.
Insert instead “, the Clarence River and Lake Woolooweyah”.

Insert “and Lake Woolooweyah” after “Clarence River” in item 2 (a) of the Table.

[4]      Clause 145 Prescribed conditions of fishing boat licences

Omit clause 145 (1) (e). Insert instead:

(e)

in the case of a licence that authorises the use of the boat for prawn trawling in the Clarence River or Lake Woolooweyah:

(i)

the length, depth and breadth of the boat, and the power rating of its engine, are not increased by more than 10% in any ten year period, and

(ii)

if the boat is replaced at any time, the length, depth and breadth of the boat (the current boat), and the power rating of its engine, are not more than 10% greater than that of any other boat used by the licensee for prawn trawling in the Clarence River or Lake

Amendments Schedule 1

Woolooweyah within the last 10 years and which the current boat replaces, and

(iii)      the engine of the boat is not replaced without the written consent of the Director, and

(iv)     a by-catch reduction device, of a kind approved by the Director, is used when the boat is used for prawn trawling in the Clarence River or Lake Woolooweyah, and

(v)       prawns caught are graded immediately after each such prawn trawl, and the sorted section of the catch is returned to the water as soon as practicable,
