Amendment (Pound nets) Regulation

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Fisheries Management Act 1994.

Explanatory note

The object of this Regulation is to prohibit the use of pound nets by including section 24 (Lawful use of nets or traps) and section 289 (the general regulation making power).
commercial fishers.
Section 24 of the Fisheries Management Act 1994 provides that a person
must not use a net for taking any fish unless its use by the person for taking
those fish is declared by the regulations to be a lawful use of the net. At
present, it is lawful for commercial fishers only to use pound nets and only
in parts of Port Stephens.
This Regulation makes it unlawful for any person to use a pound net. It also
contains consequential amendments and amendments for the purposes of law

revision.

1 Name of Regulation

This Regulation is the Fisheries Management (General)
Amendment (Pound nets) Regulation 1997.

2 Amendment of Fisheries Management (General) Regulation 1995

The Fisheries Management (General) Regulation 1995 is amended as set out in Schedule 1.

3 Notes

The explanatory note does not form part of this Regulation.

Schedule 1 Amendments

(Clause 2 )

[1]      Clause 19 Registration of fishing gear

Omit “pound net”.

[2]      Clause 41 Pound net

Omit the clause.

[3]      Part 4 Priorities in the use of fishing gear, Division 6 (clause 102)

Omit the Division.

[4]     Clauses 174, 183, 191A, 191J and 191S

Insert “In this Division:” at the beginning of each clause.

[5]     Clause 212A Definitions

Omit paragraph (e) from the definition of hauling net.
