His Excellency the Governor, with the advice of the Executive Council. has made the following Regulation under the Fisheries Management Act 1994.

Explanatory note

The object of this Regulation is to remove certain provisions in the Fisheries
Management (General) Regulation 1995 that require:
(a) the payment of a $2 fee for a commercial fishing tag (being a tag that

is required to be attached to each eastern rock lobster that is taken for

sale), and
(b) the refund of the fee for any tag that is unused and surrendered.

Section 76 of the Fisheries Management Act 1994 allows the Minister to determine, in accordance with that section. the management charges that are payable by the holders of shares in a share management fishery (including a rock lobster share management fishery).

This Regulation is made under the Fisheries Management Act 1994, including section 40 (regulations relating to general management of fisheries) and section 289 (the general regulation-making power).

1 Name of Regulation

This Regulation is the Fisheries Management (General)

Amendment (Lobster Tag Fees) Regulation 1998.

2 Amendment of Fisheries Management (General) Regulation

1995

The Fisheries Management (General) Regulation 1995 is amended by omitting clauses 119C ( 3 ) and (5). 119D (1) (a), 119G (3) and 134H (2).
