His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Fisheries Management Act 1994.

The object of this Regulation is to revise the method of calculating fees for fishing boat licences, so that if a fishing boat licence expires and the holder of the licence later applies for the issue of a new licence to replace that licence, the fee payable is the same fee that would have been payable if the person had formally placed the expired licence in abeyance in accordance with the procedure available under the Fisheries Management (General) Regulation 1995.
This Regulation is made under the Fisheries Management Act 1994, including sections 108 (2) and 289 (the general regulation-making power).

(Clause 2)

Clause 143 Fee to accompany a pplication for issue of fishing boat licence

Insert after clause 143 (3):

(4)

If an application is made (after the commencement of this subclause) for the issue of a fishing boat licence:

(a)

for a boat that was previously licensed and for which the licence has expired, or

(b)

for a boat that replaces a boat that was previously licensed and for which the licence has expired,

the application is to be dealt with as if the expired licence has been in abeyance under clause 149 since the date the expired licence would have expired but for clause 146 (6). Accordingly, the additional fee referred to in subclause (3) is payable.

(5)

The additional fee referred to in subclause (3) is not payable in respect of any day that occurred before the commencement of this subclause.

[2] Clause 146 enewal of fishing boat licence

Insert “, together with any additional fee payable under clause 143” after “concerned” in clause 146 (8).
