His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Fisheries Management Act 1994.

Explanatory note

The Fisheries Management (General) Regulation 1995 specifies the maximum number of certain fish that can be taken by a person on any one day (called a daily limit) and the maximum number of certain fish that a person may have in his or her possession in certain circumstances (called a possession limit).
The object of this Regulation is to make various changes to those maximum daily and possession limits in respect of certain fish and invertebrates and tunicates (listed in the Table to Division 3 of Part 2 of the Principal Regulation). This Regulation:

(a) sets a daily limit and possession limit for banded morwong and sawtail surgeon, and
(b) replaces the existing combined limits for the various species of lobster

with separate limits for various species.

In addition, this Regulation prohibits the use of scuba diving for the recreational taking of abalone (by removing a currently operative exemption to a general prohibition on the taking of fish while using an underwater breathing apparatus).

This Regulation is made under the Fisheries Management Act 1994, including section 17 (Bag limits-taking of fish), section 18 (Bag limits- possession of fish), section 23 (Regulations relating to fishing gear) and section 289 (the general regulation-making power).

2 Amendment of Fisheries Management (General) Regulation

1995

The Fisheries Management (General) Regulation 1995 is amended as set out in Schedule 1.
