I, the Minister for Fisheries, on the recommendation of the Fisheries Scientific Committee, make the following Order under section 220D of the Fisheries Management Act 1994.

Explanatory note

Part 7A of the Fisheries Management Act 1994 (the Act) deals with the conservation of threatened species, populations and ecological communities of fish or marine vegetation. For the purposes of identification and classification, provision is made for the listing:

(a) in Schedule 4 to the Act, of endangered species, endangered populations and endangered ecological communities and species that are presumed to be extinct, and
(b) in Schedule 5, of vulnerable species, and
(c) in Schedule 6, of key threatening processes.

Under the Act, listings and amendments to listings are to be made by the Minister by order on the recommendation of the Fisheries Scientific Committee (the Committee).

Fisheries Management Amendment (Threatened Species Conservation) Order (No 2) 2000

Explanatory note

The object of this Order is to list the grey nurse shark in Part 1 of Schedule 4 to the Act (Endangered species) and, as a consequence, to omit this species from Schedule 5 to the Act (Vulnerable species), as recommended by the Committee. The Committee has recommended that this species be listed in Part 1 of Schedule 4 because it considers that the species is likely to become extinct in nature in New South Wales unless the circumstances and factors threatening its survival or evolutionary development cease to operate.

Schedule 1.
