I, the Minister for Fisheries, on the recommendation of the Fisheries Scientific Committee, make the following Order under section 220D of the Fisheries Management Act 1994.

Explanatory note
Part 7A of the Fisheries Management Act 1994 deals with the conservation of threatened species, populations and ecological communities of fish or marine vegetation. For the purposes of identification and classification, provision is made for the listing:
| • | in Schedule 4 to the Act, of endangered species, endangered populations and endangered ecological communities and species that are presumed to be extinct, and |
| • | in Schedule 5, of vulnerable species, and |
| • | in Schedule 6, of key threatening processes. |

Explanatory note
Under the Act, listings and amendments to listings are to be made by the Minister by order on the recommendation of the Fisheries Scientific Committee. The object of this Order is to omit the honey blue-eye from Schedule 5 to the Fisheries Management Act 1994, as recommended by the Fisheries Scientific Committee. The Committee considers that, in light of its findings that the honey blue-eye has not been found to occur in New South Wales waters and has never been recorded in New South Wales, the species is ineligible for listing as a vulnerable species.

2 Amendment of Fisheries Management Act 1994—Schedule 5
Vulnerable species
The Fisheries Management Act 1994 is amended by omitting the following matter under the heading “Fish” in Schedule 5 to the Act:
*Pseudomugil mellis Allen and Ivantsoff, 1982 . . . honey blue-eye
