I, the Minister for Fisheries, on the recommendation of the Fisheries Scientific Committee, make the following Order under section 220D of the Fisheries Management Act 1994.

Part 7A of the Fisheries Management Act 1994 deals with the conservation of threatened species, populations and ecological communities of fish or marine vegetation. For the purposes of identification and classification, provision is made for the listing:

in Schedule 4 to the Act, of endangered species, endangered populations and endangered ecological communities and species that are presumed to be extinct, and

in Schedule 5 , of vulnerable species, and

in Schedule 6, of key threatening processes.

Under the Act, listings and amendments to listings are to be made by the Minister by order on the recommendation of the Fisheries Scientific Committee.

E x p l a n a t o r y n o t e

The objects of this Order are:

(a) to list the grey nurse shark and the great white shark as vulnerable species in Schedule 5 to the Fisheries Management Act 1994 (the Act), as recommended by the Fisheries Scientific Committee, because

it considers that the species are likely to become endangered unless

the circumstances and factors threatening their survival cease to operate, and
(b)	to indicate (by the insertion of an asterisk) that certain species listed in Schedules 4 and 5 to the Act are also listed under Schedule 1 or 2 to the Endangered Species Protection Act 1992 of the Commonwealth.

The explanatory note does not form part of this Order.
