Fisheries Levy (Torres Strait Prawn Fishery) Regulations 1998                  2

1Name

This is the Fisheries Levy (Torres Strait Prawn Fishery) Amendment (2014 Measures No. 1) Regulation 2014.

2Commencement

This instrument commences on the day after it is registered.

3Authority

This instrument is made under the Fisheries Levy Act 1984.

4Schedules

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1—Amendments

Fisheries Levy (Torres Strait Prawn Fishery) Regulations 1998

1  Subregulation 2(1) (definition of allocated fishing day)

Repeal the definition.

2  Paragraph 3(2)(b)

Omit “days”, substitute “fishing days”.

3  Subregulation 3(3)

Repeal the subregulation, substitute:

            (3)  For paragraphs 5(bc) and (bd) of the Levy Act, units of fishing capacity permitted for the Torres Strait Prawn Fishery under the management plan in force for that fishery are prescribed.

4  Subregulations 4(1) and (2)

Repeal the subregulations, substitute:

Licences—grant and renewal

            (1)  For subsection 6(1) of the Levy Act, the amount of levy imposed on the grant of a licence mentioned in subregulation 3(2) to a person is $3 573.12 plus $24.05 for each unit of fishing capacity mentioned in subregulation 3(3) allocated to the person in respect of the licence.

            (2)  For subsection 6(1) of the Levy Act, the amount of levy imposed on the renewal of a licence mentioned in subregulation 3(2) to a person is $3 573.12 plus $24.05 for each unit of fishing capacity mentioned in subregulation 3(3) to be held by the person in respect of the renewed licence.

5  Subregulation 4(3)

Repeal the subregulation.

6  Subregulation 4(4)

After “subregulation 3(3)”, insert “(other than a unit of fishing capacity mentioned in subregulation 4(1) or (2))”.

7  Subregulation 4(4)

Omit “$$25.63”, substitute “$24.05”.

8  Subregulation 4(5)

After “subregulation 3(3)”, insert “(other than a unit of fishing capacity mentioned in subregulation 4(1) or (2))”.

9  Subregulation 4(5)

Omit “$$25.63”, substitute “$24.05”.
