  1. These Regulations may be cited as the Fisheries Levy (South Western
Sector Trawl Fishery) Regulations.*1*

Interpretation 


  2. In these Regulations:

  "notice" means Fisheries Notice No. SET 2 made by the Minister on 7 February
1991 under subsection 8 (1) of the Fisheries Act 1952, notice of which was
published in the Gazette on 20 February 1991;

  "plan of management" has the same meaning as in the Fisheries Levy (South
East Trawl Fishery) Regulations;

  "the Act" means the Fisheries Levy Act 1984.

Prescribed class of endorsements 


  3. The following class of endorsements is prescribed for the purposes of
paragraph 5 (b) of the Act, namely, endorsements under subsection 9 (4) of the
Fisheries Act 1952 that extend a licence to authorise the use of a boat to
take fish in the waters referred to in the notice by any method that involves
towing a net or nets through water with the use of:

  (a) single vessel and otterboards; or

  (b) a single vessel and a beam trawl; or

  (c) more than one vessel.

Amount of levy 


  4. For the purposes of subsection 6 (1) of the Act, the amount of levy
imposed on an endorsement referred to in regulation 4 is $26 multiplied by the
number of units of fishing capacity allocated to the licensee, in accordance
with the plan of management, at the time of the endorsement.
