Fisheries Levy (South East Fishery) Regulations

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Fisheries Levy Act 1984.

Citation

1. These Regulations may be cited as the Fisheries Levy (South East Fishery) Regulations.

Commencement

2. These Regulations commence on 13 December 1991.

 

Interpretation

3. In these Regulations, unless the contrary intention appears:

“Act” means the Fisheries Levy Act 1984;

“plan of management” means the South East Fishery (Individual Transferable Quota) Management Plan 1991:

(a) determined by the Minister on 6 December 1991 under subsection 7b (1) of the Fisheries Act 1952; and

(b) notice of the making of which was published in the Gazette on 9 December 1991;

as that plan is in force from time to time.

Prescribed units of fishing capacity

4. (1) For the purposes of paragraph 5 (bc) of the Act, a unit of fishing capacity allocated in accordance with the plan of management is a prescribed unit of fishing capacity.

(2) For the purposes of paragraph 5 (bd) of the Act, a unit of fishing capacity renewed in accordance with the plan of management is a prescribed unit of fishing capacity.

Amount of levy

5. The amount of levy imposed by the Act on the allocation, or the renewal of allocation, of a unit of fishing capacity described in Column 2 of an item in the Table is the amount specified in respect of that item in Column 3 in the Table.
