Regulations

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Fisheries Levy Act 1984.

Citation

 1.   These Regulations may be cited as the Fisheries Levy (Northern Shark Fishery) Regulations.

Commencement

2.   These Regulations commence on 3 February 1992.

Interpretation

 3.   In these Regulations, unless the contrary intention appears:

“endorsement” means an endorsement of a licence under subsection 9 (4) of the Fisheries Act 1952;

“licence” means a licence granted under subsection 9 (2) of the Fisheries Act 1952;

“Fisheries Notice” means Fisheries Notice No. NSF 1, published in the Gazette on 8 January 1992 and in force under section 8 of the Fisheries Act 1952;

“the Act” means the Fisheries Levy Act 1984.

Prescribed classes of endorsements—paragraph 5 (b) of the Act

4.   Each of the following classes of endorsements is prescribed for the purposes of paragraph 5 (b) of the Act:

  • (a)

    endorsements of the kind referred to in paragraph 7.1 of the Fisheries Notice;

  • (b)

    endorsements of the kind referred to in paragraph 7.2 of the Fisheries Notice;

  • (c)

    endorsements of the kind referred to in paragraph 7.3 of the Fisheries Notice;

  • (d)

    endorsements of the kind referred to in paragraphs 7.1, 7.2, and 7.3 for replacement boats and that are granted simultaneously with the revocation of an endorsement of the same kind.

Amounts of levy

5.

For the purposes of section 6 (1) of the Act, the following amounts are specified:

  • (a)

    for endorsement of a licence included in the class of endorsements prescribed in paragraph 4 (a)—$1,500;

  • (b)

    for endorsement of a licence included in the class of endorsements prescribed in paragraph 4 (b)—$1,500;

  • (c)

    for endorsement of a licence included in the class of endorsements prescribed in paragraph 4 (c)—$1,500;

  • (d)

    for endorsement of a licence included in the class of endorsements prescribed in paragraph 4 (d)—no levy. 2

2. NOTE: The Fisheries Legislation (Consequential Provisions) Act 1991 provides that a licence granted under section 9 of the Fisheries Act 1952 continues in force under the Fisheries Management Act 1991
