Fisheries Levy (Northern Prawn Fishery) Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Fisheries Levy Act 1984.

1.   Amendment

1.1   The Fisheries Levy (Northern Prawn Fishery) Regulations are amended as set out in these Regulations.

 These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   Regulation 2 (Interpretation)

2.1   Definition of “applicable number of Class A units”:

Omit the definition.

2.2   Definitions of “Class A unit”, “Class B unit” and “Class C unit”:

Omit the definitions, substitute:

“ ‘Class A unit’ and ‘Class B unit’ have the same respective meanings as in the plan of management;”.

3.   Regulation 3 (Prescribed units of fishing capacity)

3.1   Omit the regulation, substitute:

“3.

The following units of fishing capacity are prescribed for the purposes of paragraphs 5 (bc) and (bd) of the Act:

• (a)

  a Class A unit that is allocated to a person in accordance with the plan of management for assignment to a licensed boat to which a Class B unit is also assigned;

• (b)

  a Class A unit that is a surplus unit.”.

4.   Regulation 4 (Amounts of levy)

4.1   Omit the regulation, substitute:

“4.

For the purposes of section 6 of the Act, the amount of levy imposed by paragraph 5 (bc) or (bd) of the Act on the allocation or the renewal of the allocation of a Class A unit of fishing capacity to which regulation 3 applies in respect of the period beginning on 14 July in a year and ending at the end of 13 December in the year is $23.50.”.
