Regulations 2(Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Fisheries Levy Act 1984.

1.   Amendment

1.1   The Fisheries Levy (Northern Fish Trawl Fishery) Regulations are amended as set out in these Regulations.

2.   Regulation 2 (Interpretation)

2.1   Omit the regulation, substitute:

Interpretation

“2. In these Regulations, unless the contrary intention appears:

“endorsement” means an endorsement of a fishing boat licence under subsection 9 (2) of the Fisheries Act;

“Fisheries Act” means the Fisheries Act 1952;

“Fisheries Notice’ means Fisheries Notice No. NTF 4 made under section 8 (1) of the Fisheries Act and published in the Gazette on 27 November 1991;

“fishing boat licence”, in relation to a boat, means a licence granted for the boat under subsection 9 (2) of Fisheries Act;

“Levy Act” means the Fisheries Levy Act 1984.”.

3.   Regulation 3 (Prescribed class of endorsements)

3.1   Omit the regulation, substitute:

Prescribed class of endorsements

 “3.For the purposes of paragraph 5 (b) of the Levy Act, the following classes of endorsements on fishing boat licences are prescribed:

  • (a)

    endorsements to authorise the use of the boat for fishing activities prohibited under paragraphs 6.2, 6.3 and 10 of the Fisheries Notice;

  • (b)

    endorsements to authorise the use of the boat for fishing activities prohibited under paragraph 6.4 of the Fisheries Notice;

  • (c)

    endorsements to authorise the use of the boat for fishing activities prohibited under paragraphs 6.2, 6.3, 6.4, and 10 of the Fisheries Notice.”.

4.   Regulation 4 (Amount of levy)

4.1   Omit the regulation, substitute:

Amount of levy

“4.

For the purposes of subsection 6 (1) of the Levy Act, the amount of levy payable is:

(a)

for an endorsement referred to in paragraph 3 (a):

 (i) if the licence is already endorsed as mentioned in paragraph 3 (b)—$4,565; or

 (ii) if the licence is not already endorsed as mentioned in paragraph 3 (b)—$9,130; or

  • (b)

    for an endorsement referred to in paragraph 3 (b):

 (i) if the licence is already endorsed as mentioned in paragraph 3 (a)—$4,565; or

 (ii) if the licence is not already endorsed as mentioned in paragraph 3  (a)—$9,130; or

(c)

for an endorsement referred to in paragraph 3 (c)—$13,695; or

(d)

for an endorsement mentioned in paragraph (a), (b) or (c) in respect of a licence granted simultaneously with the revocation of an endorsement of the same class in respect of another boat—nil.”.
