Fisheries Levy (Great Australian Bight Trawl Fishery) Regulations 2(Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Fisheries Levy Act 1984.

1.   Amendment

1.1   The Fisheries Levy (Great Australian Bight Trawl Fishery) Regulations are amended as set out in these Regulations.

[NOTE:

 These Regulations commence on gazettal: see Acts Interpretation Act 1901, s.48]

2.   Regulation 2 (Interpretation)

2.1   Insert the following definition:

‘boat licence’ means a licence granted under subsection 9 (2) or (3) of the Fisheries Act 1952;”.

3.   Regulation 3 (Prescribed units of fishing capacity—section 5 of the Act)

3.1   Omit the regulation, substitute:

Prescriptions for the purposes of section 5 of the Act

“3.

(1)  For the purposes of paragraph 5 (b) of the Act, an endorsement of a boat licence under subsection 9 (4) of the Fisheries Act 1952 is included in a prescribed class if it relates to activities described in Fisheries Notice No. GAB 1:

  • (a)

    made by the Minister of State for Primary Industries and Energy on 16 December 1990; and

(b)

published in the Gazette on 23 January 1991.

“(2)

For the purposes of paragraphs 5 (bc) and (bd) of the Act, a unit of fishing capacity allocated in accordance with the plan of management is a prescribed unit of fishing capacity.”.

4.   Regulation 4 (Amount of levy)

4.1   Omit “$6,000”, substitute “$9,000”.
