Citation 


  1. These Regulations may be cited as the Fisheries Levy (East Coast Tuna
Longline Fishery) Regulations.*1*

Commencement 


  2. These Regulations commence on 1 July 1988.

FISHERIES LEVY (EAST COAST TUNA LONGLINE FISHERY) REGULATIONS - REG 3 
Interpretation 


  3. In these Regulations, unless the contrary intention appears:

  "boat" has the same meaning as in the Fisheries Act 1952;

  "endorsement" means an endorsement under subsection 9 (4) of the Fisheries
Act 1952 of a licence, being an endorsement that extends the licence endorsed
to authorise the use of the boat in respect of which the licence is granted
for the purpose in respect of which the licence is granted in an area of
waters to which the notice applies in respect of fish to which the notice
applies;

  "licence" means a licence granted under subsection 9 (2) or (3) of the
Fisheries Act 1952;

  "Fisheries Notice No. TEC 5" means Fisheries Notice No. TEC 5, published in
the Gazette on 11 July 1991 and in force under section 8 of the Fisheries Act
1952;

  "Fisheries Notice No. TEC 8" means Fisheries Notice No. TEC 8, published in
the Gazette on 11 December 1991 and in force under section 8 of the Fisheries
Act 1952;

  "the Act" means the Fisheries Levy Act 1984.

Prescribed classes of endorsements - paragraph 5 (b) of the Act 


  4. Each of the following classes of endorsements is prescribed for the
purposes of paragraph 5 (b) of the Act:

  (a) endorsements of the kind referred to in paragraph 6 (a) of Fisheries
Notice No. TEC 5;

  (b) endorsements of the kind referred to in paragraph 6 (b) of Fisheries
Notice No. TEC 5 and in force immediately before 15 December 1991;

  (ba) endorsements of the kind referred to in paragraph 6 (b) of Fisheries
Notice No. TEC 5, other than endorsements referred to in paragraph (b);

  (c) endorsements of the kind referred to in paragraph 6 (c) of Fisheries
Notice No. TEC 5;

  (f) endorsements of the kind referred to in paragraph 5 (b) of Fisheries
Notice No. TEC 8;

  (g) endorsements of the kind referred to in paragraph 5 (c) of Fisheries
Notice No. TEC 8.

Amounts of Levy 


  5. For the purposes of subsection 6 (1) of the Act, the following amounts
are specified:

  (a) for endorsement of a licence included in the class of endorsements
prescribed in paragraph 4 (a) - $2,350;

  (b) for endorsement of a licence included in the class of endorsements
prescribed in paragraph 4 (b) - $2,075;

  (ba) for endorsement of a licence included in the class of endorsements
prescribed in paragraph 4 (ba) - $1,575;

  (c) for endorsement of a licence included in the class of endorsements
prescribed in paragraph 4 (c) - $1,075;

  (f) for endorsement of a licence included in the class of endorsements
prescribed in paragraph 4 (f) - $825;

  (g) for endorsement of a licence included in the class of endorsements
prescribed in paragraph 4 (g) - $825.*2*
*2* Regulation 5 - The Fisheries Legislation (Consequential Provisions) Act
1991 provides that a licence granted under section 9 of the Fisheries Act 1952
continues in force under the Fisheries Management Act 1991.
