Fisheries Levy (East Coast Tuna Longline Fishery) Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Fisheries Levy Act 1984.

1.   Amendment

1.1 The Fisheries Levy (East Coast Tuna Longline Fishery)

  Regulations are amended as set out in these Regulations.

 These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   Regulation 4 (Prescribed classes of endorsements—paragraph 5 (b) of the Act)

2.1   Paragraph 4 (b):

Omit “and in force immediately before 15 December 1991”.

2.2   Paragraph 4 (ba):

Omit the paragraph.

3.   Regulation 5 (Amount of levy—subsection 6 (1) of the Act)

3.1   Omit “For”, substitute “Subject to regulation 6, for”.

3.2   Paragraph 5 (a):

Omit “$2,350”, substitute “$2,000”.

3.3   Paragraph 5 (b):

Omit “$2,075”, substitute “$1,765”.

3.4   Paragraph 5 (ba):

Omit the paragraph.

3.5   Paragraph 5 (c):

Omit “$1,075”, substitute “$935”.

3.6   Paragraph 5 (f):

Omit “$825”, substitute “$900”.

3.7   Paragraph 5 (g):

Omit “$825”, substitute “$900”.

4. New

regulation 6

4.1   After regulation 5, insert:

Amount of levy—multiple endorsements

“6.

If a licence is endorsed with:

• (a)

  an endorsement in a class of endorsements referred to in regulation 5; and

• (b)

  one or more endorsements in a different class or in different classes of endorsement referred to in regulation 5 or in regulation 4 of the Fisheries Levy (East Coast Tuna Purse Seine Fishery) Regulations; and

• (c)

  each of the endorsements is in respect of the same period;

for the purposes of subsection 6 (1) of the Act, the amount specified for each of those endorsements is the amount calculated by the formula:

where:

‘A’ is:

• (a)

  where the same amount is specified in regulation 5 or in regulation 4 of the Fisheries Levy (East Coast Tuna Purse Seine Fishery) Regulations for each of those endorsements—that amount; or

• (b)

  in any other case—the greater or greatest (as the case may be) of the amounts specified in regulation 5 or in regulation 4 of the Fisheries Levy (East Coast Tuna Purse Seine Fishery) Regulations for those endorsements; and

‘E’ is the number of those endorsements.”.
