Fisheries Levy (East Coast Deepwater

Finfish Trawl Fishery) Regulations

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Fisheries Levy Act 1984.

Citation

1.  These Regulations may be cited as the Fisheries Levy (East Coast Deepwater

Finfish Trawl Fishery) Regulations.

Interpretation

2.  In these Regulations, unless the contrary intention appears:

“endorsement” means an endorsement under subsection 9 (4) of the Fisheries Act 1952 on a licence, being an endorsement that extends the licence endorsed to authorise the use of the boat in respect of which the licence is granted for the purpose in respect of which the licence is granted in the area of waters to which Fisheries Notice No. 201 published in the Gazette on 2 December 1987 and in force under section 8 of that Act applies in respect of fish to which that notice applies;

“licence means a licence granted under subsection 9 (2) or (3) of the Fisheries Act

1952;

“the Act” means the Fisheries Levy Act 1984.

Prescribed classes of endorsements-paragraph 5 (b) of the Act

3.  Each of the following classes of endorsements is prescribed for the purposes

of paragraph 5 (b) of the Act:

(a)

endorsements each of which is made in a licence that relates to a boat that does not exceed 20 metres in length where the endorsement is to remain in force during a period that does not exceed one month in duration;

(b)

endorsements each of which is made in a licence that relates to a boat that does not exceed 20 metres in length where the endorsement is to remain in force during a period that exceeds one month but that does not exceed 2 months in duration;

(c)

endorsements each of which is made in a licence that relates to a boat that does not exceed 20 metres in length where the endorsement is to remain in force during a period that exceeds 2 months but that does not exceed 3 months in duration;

(d)

endorsements each of which is made in a licence that relates to a boat that exceeds 20 metres in length where the endorsement is to remain in force during a period that does not exceed one month in duration;

(e)

endorsements each of which is made in a licence that relates to a boat that exceeds 20 metres in length where the endorsement is to remain in force during a period that exceeds one month but that does not exceed 2 months in duration;

(f)

endorsements each of which is made in a licence that relates to a boat that exceeds 20 metres in length where the endorsement is to remain in force during a period that exceeds 2 months but that does not exceed 3 months in duration.

Amounts of levy

4. For the purposes of subsection 6 (1) of the Act, the following amounts are

specified:

(a)

in respect of endorsement of a licence included in the class of endorsements referred to in paragraph 3 (a)-$100;

(b)

in respect of endorsement of a licence included in the class of endorsements referred to in paragraph 3 (b)-$200;

(c)

in respect of endorsement of a licence included in the class of endorsements referred to in paragraph 3 (c)-$300;

(d)

in respect of endorsement of a licence included in the class of endorsements referred to in paragraph 3 (d)-$500;

(e)

in respect of endorsement of a licence included in the class of endorsements referred to in paragraph 3 (c)-$1,000;

(f)

in respect of endorsement of a licence included in the class of endorsements referred to in paragraph 3 (f)-$1,500.
