Fisheries Levy (Bass Strait Scallop Fishery)

Regulations

  

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Fisheries Levy Act 1984.

Citation

 1.These Regulations may be cited as the Fisheries Levy (Bass Strait Scallop Fishery) Regulations.

 

Interpretation

2. In these Regulations, unless the contrary intention appears:

“Act” means the Fisheries Levy Act 1984;

“Plan of Management” means Plan of Management No. BSS1:

• (a)

  determined on 18 April 1991 under subsection 7b (1) of theFisheries Act 1952; and

• (b)

  the making of which was notified in the Gazette on 1 May 1991; and

(c)

as in force from time to time.

  

Prescribed units of fishing capacity

3. For the purposes of paragraphs 5 (bc) and (bd) of the Act, a unit of fishing capacity allocated, or renewed, in accordance with the Plan of Management is a prescribed unit of fishing capacity.

  

Amount of levy

4. For the purposes of subsection 6 (1) of the Act, the amount of levy on the allocation or renewal of a prescribed unit of fishing capacity specified in regulation 3 is $2,000.
