Fisheries (Infringement Notices) Amendment Regulations (No. 2) 2008

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Living Marine Resources Management Act 1995 .30 June 2008

1Short titleThese regulations may be cited as the Fisheries (Infringement Notices) Amendment Regulations (No. 2) 2008 . 2CommencementThese regulations take effect on 1 August 2008. 3Principal RegulationsIn these regulations, the Fisheries (Infringement Notices) Regulations 2001 are referred to as the Principal Regulations. 4Regulation 8 rescinded Regulation 8 of the Principal Regulations is rescinded. 5Schedule 1 amended (Offences under Living Marine Resources Management Act 1995) Schedule 1 to the Principal Regulations is amended by inserting after

Cutting, damaging, destroying or removing prescribed marine plants

Failing to comply with a research area order

6Schedule 6 rescinded Schedule 6 to the Principal Regulations is rescinded.

These regulations are administered in the Department of Primary Industries and Water.

EXPLANATORY NOTE

(This note is not part of the regulation) These regulations amend the

(a) prescribing a further offence under the Living Marine Resources Management Act 1995 for which an infringement notice may be issued; and (b) omitting certain infringement notice offences and penalties that are provided for in the Fisheries (Scalefish) Rules 2004 as amended.
