Fisheries (Fees, Royalties and Levies) Amendment Regulations 2020

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Fisheries (Fees, Royalties and Levies) Regulations 2017—

(a)to amend levies for commercial fishery licences and individual quota units; and

(b)to revoke notes indicating the bodies to whom the Minister will make a grant, out of the proceeds of certain levies.

2Authorising provisions

These Regulations are made under sections 151 and 153 of the Fisheries Act 1995.

3Commencement

These Regulations come into operation on 1 April 2020.

4Levies on fish receiver licences

In regulation 20(2) of the Fisheries (Fees, Royalties and Levies) Regulations 2017[1]—

(a)in paragraph (b), for "80·2 fee units" substitute "96·2 fee units";

(b)in paragraph (d), for "238·9 fee units" substitute "237·4 fee units".

5Levies on individual quota units

The note at the foot of regulation 22 of the Fisheries (Fees, Royalties and Levies) Regulations 2017 is revoked.

6Levy for making grants under section 151(5) of the Act

The note at the foot of regulation 24 of the Fisheries (Fees, Royalties and Levies) Regulations 2017 is revoked.

7Schedule 3 substituted

For Schedule 3 to the Fisheries (Fees, Royalties and Levies) Regulations 2017 substitute

Fee Units

These Regulations provide for fees by reference to fee units within the meaning of the Monetary Units Act 2004.

The amount of the fee is to be calculated, in accordance with section 7 of that Act, by multiplying the number of fee units applicable by the value of a fee unit.

The value of a fee unit for the financial year commencing 1 July 2019 is $14.81. The amount of the calculated fee may be rounded to the nearest 10 cents.

The value of a fee unit for future financial years is to be fixed by the Treasurer under section 5 of the Monetary Units Act 2004. The value of a fee unit for a financial year must be published in the Government Gazette and a Victorian newspaper before 1 June in the preceding financial year.
