Fisheries (Fees, Levies and Royalties) Regulations
2003
The Governor in Council makes the following Regulations:

1. Objective
The objective of these Regulations is to amend the
Fisheries Regulations 1998—
(a) to increase certain fees and levies;
(b)
to adjust the basis of calculation of royalties for Abalone Fishery Access Licences.
2. Authorising provision
These Regulations are made under section 153 of the Fisheries Act 1995.
3. Commencement
These Regulations come into operation on 1 April
2003.

4. Fishing boat registration fees increased
In regulations 605(2), 605(3) and 611(2) of the
Fisheries Regulations 19981 for "$34" substitute"$35".
5. Commercial fishery licence fees increased
In regulations 614 and 624 of the Fisheries
Regulations 1998, for "$34" substitute "$35".
6. Aquaculture licence fees and levy increased
In regulation 617A of the Fisheries Regulations
1998—
(a)
in sub-regulation (1), for "$1145" substitute "$1179";
(b)
in sub-regulation (3), for "$180" substitute "$185";
(c)
in sub-regulation (6), for "$902" (where twice occurring) substitute "$929".
7. General permit levy increased
In regulation 617B of the Fisheries Regulations
1998, for "$3152" substitute "$3247".8. Adjustment to basis of calculation of royalties for Abalone Fishery Access Licences
For regulation 620(2) of the Fisheries Regulations
1998 substitute—
"(2) The royalty payable in respect of an Abalone
Fishery Access Licence is the amount calculated in accordance with the following formula—
T − 1 TAC in year X
5000 × × − F
3 ⋅ 2 TAC in base year Y + (5% of TAC in base year Y) where—
T – 1 is the average beach
price of abalone for the

section 64A of the Act

levies and charges
imposed on the licence.Note: In the base year the total allowable catch
(TAC) for the eastern abalone zone was

460 tonnes of unshucked abalone; the TAC for
the central abalone zone was 700 tonnes of
unshucked abalone; and the TAC for the
western abalone zone was 280 tonnes ofunshucked abalone.".
9. Individual quota units transfer fee increased
In regulation 622 of the Fisheries Regulations
1998—
(a)
in paragraph (a) for "$180" substitute "$185";
(b)
in paragraphs (b), (c) and (d), for "$34" substitute "$35".
10. General permit fees increased
In regulation 625 of the Fisheries Regulations
1998—
(a)
in sub-regulations (1) and (3), for "$100" substitute "$103";
(b)
in sub-regulation (2), for "$264" substitute "$272".
11. New Schedule 12 substituted
For Schedule 12 of the Fisheries Regulations 1998 substitute—
