s1 2 s3 Fisheries (East Coast Trawl) Amendment Management No. 209, 2001 Plan (No. 2) 2001 1 Short title This management plan may be cited as the Fisheries (East Coast Trawl) Amendment Management Plan (No. 2) 2001 . 2 Management plan amended This management plan amends the Fisheries (East Coast Trawl) Management Plan 1999. 3 Insertion of new s 15A Chapter 2, part 1, division 2, subdivision 3— insert— ‘15A Closed waters—reef world heritage area (1) This section applies if, in the reef world heritage area during an effort year as follows, all of the fishing and steaming days are used for the following total number of notional effort units for the year— (a) for 2001—2 264 471; (b) for 2002—2 193 731; (c) for 2003—2 125 113. (2) The waters of the reef world heritage area are closed from midday on the day that is 5 clear days after the day on which the fishing and steaming days are used until midday on 1 January in the next year. Example for subsection (2) If the fishing and steaming days are used on a Monday, the waters are closed from midday on the next Sunday until midday on 1 January in the next year. (3) Immediately after the fishing and steaming days are used, the chief executive or an inspector must give each holder of a ‘T1’ licence and each person in control of a boat identified in a ‘T1’ licence notice of— (a) the date the fishing and steaming days were used; and (b) the date the waters become closed waters under subsection (2). (4) The notice to each holder of a ‘T1’ licence must be given in writing. (5) The notice to each person in control of a boat may be given— (a) in writing or orally in person; or

(6) The following activities are prohibited in the closed waters— (a) using or possessing a trawl net under a ‘T1’ fishery symbol; (b) possessing fish taken by the use of a trawl net under a ‘T1’ fishery symbol. (7) In this section— “notional effort units” , for an effort year, means effort units that would have been worked out under section 78 for each eligible licence had the number of allocated days for the licences been increased by 14. “reef world heritage area” means the area within the following boundary— from the northern tip of Cape York Peninsula at low water mark to latitude 10º40.91' south, longitude 145º00.06' east to latitude 12º59.91' south, longitude 145º00.06' east to latitude 14º59.91' south, longitude 146º00.06' east to latitude 17º29.91' south, longitude 147º00.06' east to latitude 20º59.91' south, longitude 152º55.06' east to latitude 24º29.90' south, longitude 154º00.06' east to the mainland shore at its intersection with latitude 24º29.91' south at low water mark along the shore at low water mark to the northern tip of Cape York Peninsula at low water mark.’. 4 Amendment of s 31 (Licences and fishery symbols for the fishery) Section 31(2), after ‘M1’— insert— ‘ ‘M2’,’.
s5 4 s7 Fisheries (East Coast Trawl) Amendment Management No. 209, 2001 Plan (No. 2) 2001 5 Replacement of s 114 (Special conditions for effort units for ‘T1’ licence) Section 114— omit, insert— ‘114 Special condition for effort units for ‘T2’ licence ‘The chief executive may approve a transfer to a ‘T1’ licence of half the effort units for a ‘T2’ licence only if the transferor gives the chief executive notice that the transferor surrenders— (a) the ‘T2’ licence; and (b) the other half of the transferor’s effort units for the ‘T2’ licence.’. 6 Amendment of s 118 (Effort unit surrender requirement if licence not transferred) Section 118(1), ‘section 114(3)’— omit, insert— ‘section 114’. 7 Omission of s 227A (Ecological sustainability action for reef world heritage area) Section 227A— omit.
