s1 2 s2 Fisheries (Cawarral Creek Fish Habitat Reserve) No. 427, 1994 ˙ Short title 1. This regulation may be cited as the Fisheries (Cawarral Creek Fish Habitat Reserve) Regulation 1994 . ˙ Fish habitat reserve declared—Act, s 51 2.(1) In this section— “roadway” means land dedicated as a road for public use, or reserved for roads, under the Land Act 1962 . (2) Tidal land within the outer boundary shown on plan no. 015–056 1 and the waters covering the land are set apart and declared a fish habitat reserve. 2 (3) However, the reserve does not include the following— (a) land within 30 m of the centre line of the Keppel Sands trunk water main; (b) land within 10 m of the centre line of the vehicular track from Savages Road to portion 2277 in the County of Livingstone; (c) land under, or land within 50 m of, the boat ramp on the north bank of Cawarral Creek; (d) land under, or land within 50 m of, the boat ramp on the south bank of Cawarral Creek; (e) land within 20 m (on the downstream side) of roadway crossing a waterway; (f) portions 1548 and 2277 in the County of Livingstone; (g) land held under Miners’ Homestead Lease no. 31; (h) the waters covering the land mentioned in paragraphs (a) to (g) or subsection (4). 1 The plan is held by the department and may be inspected at the department’s office at 80 Ann Street, Brisbane. 2 Section M.1(4) of the Fisheries Regulation 1977 exempts certain land and navigable channels from restrictions applying in fish habitat reserves.
s2 3 s2 Fisheries (Cawarral Creek Fish Habitat Reserve) No. 427, 1994 (4) The reserve also does not include land within 20 m (on the downstream side) of the downstream trend line across a waterway of roadway interrupted by a waterway.
