FISHERIES AND OYSTER FARMS ACT 1935 - REGULATION

(Relating to the use of prawn running nets on Lake Illawarra)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Fisheries and Oyster Farms Act 1935, has been pleased to make the Regulation set forth hereunder.

The Fisheries and Oyster Farms (Nets and Other Fishing Gear)
Regulation 1989 is amended by inserting after clause 25 (1) (b) the
following paragraph: 
(c) In the case of a net that is being used for taking prawns in the waters of Lake Illawarra:

(i)         the net must be operated by at least 2 licensed fishermen; and

(ii)        the net must not be operated by, or with the assistance of, any licensed fisherman who is also operating, or assisting in the operation of, any other such net.

EXPLANATORY NOTE

The object of this Regulation is to amend the Fisheries and Oyster Farms (Nets and Other Fishing Gear) Regulation 1989 to provide that a prawn running net used on Lake Illawarra must be operated by at least 2 licensed fisherman but must not be operated by (or with the assistance of) a license d fishcrman who is also operating (or assisting in the operation of) another prawn running net.
