FISHERIES AND OYSTER FARMS ACT 1935—REGULATION

(Relating to the use by licensed fishermen of spears, spearguns and

similar devices)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Fisheries and Oyster Farms Act 1935, has been pleased to make the Regulation set forth hereunder.

The Fisheries and Oyster Farms (General) Regulation 1989 is amended

by inserting after clause 7 (3) the following subclause:

(4) For the purposes of section 25 (5) of the Act, a fisherman's licence is subject to the condition that the holder of the licence is not to take for sale any fish by means of a spear, speargun or similar device except by a gaff.

EXPLANATORY NOTE

The object of this Regulation is to amend the Fisheries and Oyster Farms (General) Regulation 1989 to restrict the use of spears, spearguns and similar devices so as to prevent a poorer quality of fish being marketed and the depletion of territorial species.

This Regulation is made under section 25 (5) of the Fisheries and Oyster Farms

Act 1935.
